1. Overview
tera.photos ("Service", "we", "us", or "our") provides an online platform for photo storage, organization, and sharing. By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
The Service is designed to allow users to upload, store, organize, and share photographs through an interactive online platform. We act as a storage and hosting provider — similar to cloud storage services — and do not exercise editorial control over user-uploaded content.
2. The Service
2.1 Permitted Use
You may access and use the Service for personal or business photo storage and sharing purposes in accordance with these Terms. The Service is intended for lawful use only.
2.2 Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must promptly notify us if you become aware of any unauthorized use of your account.
2.3 Sharing Settings
Through the Service, you control who you share your photos and collections with, including making content public. We have no liability for how others may access or use your content as a result of your sharing decisions.
2.4 Restrictions
You agree not to:
- Upload, store, or share any illegal, infringing, or harmful content
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service's operation
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use the Service to store or transmit malware or viruses
- Resell, redistribute, or sublicense the Service without authorization
3. Customer Content
3.1 Ownership
You retain full ownership of all photos and content you upload to the Service ("Customer Content"). We do not claim any ownership rights over your Customer Content.
3.2 License Grant
By uploading content to the Service, you grant us a non-exclusive, worldwide license to host, store, back up, process, transmit, and display your Customer Content solely to provide, maintain, and improve the Service. This includes creating thumbnails, previews, and optimized versions of your images for delivery purposes.
3.3 Your Responsibility
You are solely responsible for your Customer Content and the consequences of uploading or sharing it. You represent and warrant that you have all necessary rights to upload and share your content, and that your content does not violate any third-party rights or applicable laws.
3.4 No Sale of Content
We do not sell your Customer Content to third parties. We do not use your Customer Content to train machine learning models that are made available to third parties.
4. Third-Party Infrastructure
The Service is powered by enterprise-grade cloud infrastructure providers. Your images and data are stored on industry-leading cloud storage platforms designed for durability and reliability.
While we carefully select our infrastructure partners and implement reasonable measures to protect your data, we are not responsible for any interruptions, data loss, or service disruptions caused by our third-party infrastructure providers. Your use of the Service is subject to the terms and conditions of these third-party providers.
5. Service Availability
We strive to maintain high availability using enterprise-grade infrastructure and content delivery networks. We are committed to providing reliable service and will make reasonable efforts to minimize downtime.
However, we do not guarantee 100% uptime. The Service may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our control. We will endeavor to provide advance notice of scheduled maintenance when possible.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.
6. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data, photos, or content
- Data corruption or unavailability
- Service interruptions or downtime
- Unauthorized access to your account
- Any damages arising from third-party infrastructure failures
- Loss of profits, revenue, or business opportunities
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us for the Service during the twelve (12) months preceding the claim.
We are not responsible for any content uploaded by users. As a storage provider, we do not review, monitor, or endorse user-uploaded content.
7. Content Moderation
While we do not actively monitor user content, we reserve the right to remove any content that we determine, in our sole discretion, violates these Terms, is illegal, or is otherwise objectionable.
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Uploading illegal or infringing content
- Engaging in fraudulent or abusive behavior
- Non-payment of fees
- Extended periods of inactivity
Upon termination, your right to use the Service will immediately cease. We may delete your account and all associated data after a reasonable period following termination.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date.
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.
9. Indemnification
You agree to indemnify, defend, and hold harmless tera.photos and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your Customer Content
- Your violation of these Terms
- Your violation of any third-party rights
10. General Provisions
10.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and tera.photos regarding the Service.
10.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
10.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
10.4 Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including natural disasters, war, terrorism, riots, government actions, or internet or utility failures.
